1. Acceptance of Terms
By downloading, accessing, or using the Serviciti mobile application (“App”) or website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Services
Serviciti is a platform that connects users seeking services (“Users”) with professionals or service providers (“Specialists”). Serviciti facilitates discovery, communication, and visibility but does not directly participate in the provision or payment of services.
3. Account Registration
To use certain features of the App, Users and Specialists must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account and password.
4. User Conduct
You agree not to:
- Use the App for unlawful or fraudulent purposes
- Post or share false, misleading, or defamatory content
- Violate the rights of others, including privacy or intellectual property rights
- Use automated systems or bots to access the App
5. Payments and Subscriptions
Specialists are required to pay a subscription fee ($29/month or $300/year) for their services to be listed and discoverable. Optional promotional fees ($5) may also be paid to appear in featured positions. All payments are final and non-refundable unless otherwise required by law.
6. Third-Party Payment Processing
Payments made between Users and Specialists for services rendered are conducted independently and are not managed by Serviciti. We are not responsible for disputes, chargebacks, or liabilities arising from third-party transactions.
7. Content Ownership and License
By posting content to the App, you grant Serviciti a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the platform. You retain ownership of your intellectual property.
8. Verification and Reviews
Serviciti may verify specialist credentials but does not guarantee the quality, safety, legality, or outcome of services. Reviews are user-generated and do not represent the opinion of Serviciti.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind. We do not warrant that the App will be error-free, uninterrupted, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Serviciti shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App or services rendered through it.
11. Indemnification
You agree to indemnify, defend, and hold harmless Serviciti, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your interaction or disputes with other users or Specialists
- Your violation of any third-party rights or applicable law
12. Termination
We reserve the right to suspend or terminate your access to the App at our discretion, without notice, if you violate these Terms or engage in harmful conduct.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the App after such changes constitutes your acceptance of the new Terms. It is your responsibility to review them periodically.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law principles.
15. Dispute Resolution
Any disputes shall first attempt to be resolved through good-faith negotiations. If unresolved, disputes will be submitted to binding arbitration.
